These Terms of Business are provided for publication on our website. They must be legally reviewed before they are relied upon as your formal client terms.
Please read these Terms of Business carefully before instructing Alexandria Hamilton. By completing our online property-information form, accepting these terms and paying the applicable fixed fee, you agree to be bound by them.
Alexandria Hamilton is a licensed UK estate agency registered in England and Wales (Company No. 16936042). Our registered address is 71-75 Shelton Street, London, WC2H 9JQ. We are registered with the Information Commissioner’s Office (ICO) under registration number ZC075827 and are members of the Property Redress Scheme (Membership No: PRS056063).
We offer two fixed-fee residential sales listing packages. The service provided under each package is otherwise identical; the only difference is portal coverage.
Both packages include the same professional estate agency support, including buyer-enquiry handling, viewing appointment arrangements, offer management and negotiation support. Neither package includes accompanied viewings unless purchased as an optional extra.
A bespoke full estate agency service (including property visits, pricing advice and full marketing preparation) is available separately on a tailored quotation—contact us to enquire. It is not part of either fixed-fee package.
Before you choose a package and pay, you must complete our online property-information form and supply:
You are responsible for ensuring that all information, photographs, descriptions, measurements and material information are accurate, complete and not misleading. You must comply with applicable material-information requirements and notify us promptly of any change.
No seller account, registration or login is required to use our online listing form.
The applicable fixed fee (£695 for the Zoopla package or £895 for the Rightmove + Zoopla package) is payable upfront after you have completed your listing information and accepted these Terms of Business. Fees are inclusive of VAT where applicable unless stated otherwise. We do not charge commission on the sale of your property.
Optional extras (such as professional photography, EPC, floorplans, For Sale boards, Premium Rightmove placement and accompanied viewing blocks) are charged at the prices displayed at the time of purchase or as separately confirmed. Accompanied viewings are sold in blocks of 10 for £299 unless otherwise stated.
Payment does not mean your property will be published immediately. After payment, Alexandria Hamilton will contact you separately to:
If we cannot complete the required checks, or if you are not authorised to sell the property, we may be unable to proceed lawfully. In those circumstances we will explain the position to you and, where we cannot proceed, we will treat any refund in line with our legal obligations and these terms.
Alexandria Hamilton will review the property information, material information, photographs, description and measurements you have supplied. We may request corrections or additional information. You must approve the final advert before it is published.
Your property will be published on the portal(s) in your chosen package only after we have completed the checks in section 5 and received your approval of the final advert.
Publication timing: We aim to publish your property within 24 hours after all required identity, ownership and anti-money-laundering checks have been completed and you have approved the final advert. Portal processing times may also apply. The 24-hour period does not begin when payment is made.
We may refuse or suspend publication if we reasonably consider that information is inaccurate, incomplete, non-compliant or that we cannot lawfully market the property.
Your listing will normally remain active for up to six months from first publication unless sold subject to contract, you withdraw your instruction, or we agree otherwise. Portal delays outside our reasonable control may affect when a listing appears.
Alexandria Hamilton handles buyer enquiries received through the relevant portals, arranges viewing appointments and manages offers. Unless you have purchased accompanied viewings, you conduct viewings at the property yourself.
Accompanied viewings (£299 per block of 10): subject to location and availability. Viewings are booked through us with reasonable notice. Unused viewings in a block do not roll over or convert to a refund unless agreed. Additional blocks may be purchased.
We will communicate offers to you promptly, support negotiation and issue a memorandum of sale when a sale is agreed. We provide agency-led sales progression. The decision to accept, reject or counter an offer rests with you. We are required to pass on written offers in accordance with applicable law.
We do not automatically share a buyer’s telephone number or email address with the seller.
Where direct communication between buyer and seller is requested during sales progression, the buyer is shown a separate, unticked consent in the following form (with the property address inserted):
I agree that Alexandria Hamilton may share my name, telephone number and email address with the seller of [property address] so that we can communicate directly during sales progression. I understand that I can withdraw this permission at any time.
We keep a record of the wording shown, the buyer’s decision, the date and time, the property address, the details authorised for sharing and any withdrawal of permission. Sellers may receive transaction updates without receiving the buyer’s personal contact information unless the buyer has given the consent above.
You are responsible for ensuring that a valid Energy Performance Certificate (EPC) is available where required before marketing. We can arrange an EPC as an optional extra if you instruct us to do so.
Any automated pricing reports use publicly available data (including HM Land Registry) and are reviewed by a qualified agent where provided. They are for guidance only and do not constitute a formal RICS valuation.
You may withdraw your instruction at any time by notifying us in writing. If you withdraw after your listing has been published, the fixed listing fee paid is non-refundable. If you withdraw before publication, we will consider refund requests on a case-by-case basis, including where we cannot lawfully proceed.
Your statutory cancellation rights (if any) are not affected where applicable. Services begin once we start carrying out compliance and listing work after payment; we will provide information about cancellation rights before you pay where required by law.
Unless otherwise agreed in writing, our fixed-fee packages do not grant sole agency or sole selling rights. If you require sole selling rights, contact us to agree terms separately.
If you are unhappy with our service, please contact us using the details on our website. Our Complaints Procedure explains how we handle complaints. If we cannot resolve your complaint, you may refer it to the Property Redress Scheme at theprs.co.uk (Membership No: PRS056063).
We process personal data in accordance with our Privacy Notice. We retain records (including consent records relating to buyer data sharing) for as long as necessary to provide our services, meet legal and regulatory requirements, and resolve disputes.
We will carry out our services with reasonable skill and care. We do not guarantee that your property will sell within any particular timeframe or at any particular price. Our liability to you in connection with our services is limited to the total fees paid by you to us for the relevant instruction, except where liability cannot be limited by law.
These Terms of Business are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to any rights you may have as a consumer.
